Terms of Service

1. Agreement

These Terms (“Terms”) govern your use of MyAIAccountant (the “Service”) operated by Elite AI Empire LLC. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

The Service is AI-assisted bookkeeping and accounting software. It categorizes transactions, generates draft financial statements, and prepares draft tax-related forms. Output is informational only and is not financial, tax, accounting, legal, or investment advice. You are solely responsible for reviewing every output before relying on it for business decisions or filing with any government agency.

3. AI disclaimer — cited authoritative sources

AI categorization and deduction-scanning are suggestive, not authoritative. We target >97% accuracy after 30 days of training, but errors will occur. You are responsible for reviewing flagged transactions.

AI bookkeeping assistance with cited authoritative sources. Our AI categorizer and deduction scanner ground recommendations in IRS publications, SBA guidance, AICPA practice notes, and state DOR pages. Each recommendation surfaces the source URL so you can verify the rule yourself. The AI will refuse to recommend deductions outside the cited materials. Confirm with a tax professional or directly with the IRS for your specific situation before filing.

We are not a CPA firm and do not provide CPA-licensed advice. Always consult a qualified tax professional before filing with the IRS, state agencies, or any third party.

4. Your account

• You are responsible for keeping your password secure and for all activity under your account.
• You must be 18+ and legally able to enter contracts in your jurisdiction.
• One natural person per account (Pro tier and above support multiple team seats).
• Don’t share login credentials. Don’t scrape or reverse-engineer the Service.

5. Pricing, billing, refunds

Subscription pricing is shown on the pricing page. Billing recurs monthly or annually depending on your plan. Annual plans are discounted 20%.

30-day refund: if you are unhappy in the first 30 days of a paid subscription, email iastudilloi@gmail.com and we’ll refund the most recent payment in full, no questions asked.

60-day money-back on annual plans: annual subscribers get an extended 60-day window.

Cancel any time from Settings → Billing. Cancellation takes effect at the end of the current billing period.

6. Account termination

We may suspend or terminate your account if you (a) violate these Terms, (b) use the Service to commit fraud or illegal activity, (c) fail to pay invoices after 14 days’ notice, or (d) misuse the AI in ways that harm other users or our infrastructure. We will give you 30 days to export your data before deletion, except in cases of fraud or legal demand.

You may close your account at any time from Settings. We export your books to CSV / JSON / QBO at no charge.

7. Data ownership

You own your data. You grant us a non-exclusive license to process it solely to operate the Service. We do not sell your data, train AI models on it, or share it with third parties for marketing.

8. Service availability

We target 99.5% monthly uptime but do not guarantee uninterrupted service. Scheduled maintenance is announced 24h in advance. We are not liable for outages caused by upstream providers (Stripe, Plaid, AWS, Hetzner).

9. Limitation of liability

To the maximum extent allowed by law, our total liability is capped at the greater of (a) $100 USD or (b) the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or IRS penalties resulting from reliance on Service output.

10. Indemnification

You agree to indemnify Elite AI Empire LLC from claims arising out of (a) your misuse of the Service, (b) your violation of these Terms, or (c) your violation of any third-party right (including IP, privacy, or tax law).

11. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Disputes go to the state or federal courts located in Santa Clara County, California.

12. Changes to Terms

We may update these Terms. Material changes will be emailed to active users 30 days before they take effect. Continued use after the effective date constitutes acceptance.
